Settlement Results

It is not uncommon for collection lawsuits to be dismissed or settled for a discounted amount, as there are many factors that can impact the outcome of a case. The court where the case is filed, the creditor pursuing the debt, and the creditor’s attorney can all play a role in the case’s resolution.

Additionally, the documents that the plaintiff presents in court can be crucial in determining the outcome of the case. If the plaintiff is unable to provide adequate documentation supporting their claim, the court may dismiss the case or rule in favor of the debtor.

It is important to note that every case is unique, and the outcome of one case may not necessarily predict the outcome of another. If you are facing a collection lawsuit, it is important to consult with a knowledgeable attorney who can provide guidance and advocate on your behalf. Zermay Law is a great resource for anyone in need of legal representation in a debt collection matter.

Settlement can be a viable option in many cases and can result in a significant reduction of the amount owed. However, the specific terms of any settlement agreement will depend on various factors, such as the amount of debt owed, the creditor’s willingness to negotiate, and the debtor’s ability to make payments.

It’s important to note that there are no guarantees in debt settlement negotiations, and any promises of settling a case for “pennies on the dollar” should be viewed with skepticism. In general, settlements typically range from 30% to 50% of the lawsuit principal balance at the time of filing, although some may settle for less.

As a debt defense lawyer, our role is to provide you with the best legal advice and guidance based on your specific situation. We will work with you to evaluate your options and discuss the pros and cons of each so that you can make an informed decision about how to proceed.

Low cost bankruptcy fee…as last resort.

When a creditor dismisses a lawsuit “without prejudice,” it means they are voluntarily ending the lawsuit, but they have the option to re-file the case at a later time if they choose to do so, as long as they are still within the statute of limitations.

Dismissal “without prejudice” does not prevent the creditor from pursuing the debt in the future, but it does give the defendant some temporary relief from the lawsuit. To permanently resolve the debt, the defendant would need to win the case at trial, settle the lawsuit with a valid debt settlement agreement, or have the creditor agree to a release of the debt.
